Just let me be sure I understand. Are you saying that WeirdOrig.pdf has that
upgrade notice as a background layer. And that the front layer is is an xml
form which GS can't  handle. So it writes the form to the back - meaning the
the front layer is now that uprade notice and what looks like the normal pdf
image is now hidden behind the upgrade notice?
